1. Acceptance of Terms
By accessing or using Afrofluencer ("the Platform"), a trading name of Powercave Int'l Ltd, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform. These terms apply to all users, including brands, influencers, and visitors.
2. Description of Service
Afrofluencer is an online marketplace that connects brands with influencers across Africa. The Platform enables brands to discover creators, purchase content packages, run campaigns, and manage collaborations. Influencers can create profiles, list services, and receive payments for completed work.
3. User Accounts
You must create an account to use most features of the Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
You agree to provide accurate, current, and complete information during registration and to update such information as necessary. Afrofluencer reserves the right to suspend or terminate accounts that contain inaccurate or misleading information.
You must be at least 18 years of age to create an account and use the Platform.
4. Influencer Obligations
Influencers agree to deliver content as described in their packages within the agreed timeframe. All content must be original or properly licensed for use.
Influencers must not artificially inflate follower counts, engagement metrics, or other statistics. Accounts found to engage in fraudulent activity may be suspended or permanently banned.
Influencers are responsible for complying with applicable advertising and disclosure regulations, including clearly identifying sponsored content.
5. Brand Obligations
Brands agree to provide clear campaign briefs and requirements when purchasing packages or posting campaigns. Payment must be made at the time of booking.
Brands must review and respond to delivered content within a reasonable timeframe. Failure to respond within 7 days of delivery may result in automatic approval and release of payment.
6. Payments and Escrow
All payments are processed securely through Paystack. When a brand purchases a package, funds are held in escrow until the brand approves the delivered content.
Upon approval, the influencer receives the payment minus the platform commission. Commission rates vary based on the brand's subscription tier and the influencer's country.
Afrofluencer is not responsible for delays in payment processing caused by third-party payment providers or banking institutions.
7. Fees and Commission
Afrofluencer charges a commission on each completed transaction. The standard commission rate is displayed on the pricing page and may vary by country. Brands on the Pro plan benefit from reduced commission rates.
All prices listed on influencer packages are the total amount paid by the brand. The commission is deducted from the influencer's payout.
8. Cancellations and Refunds
Orders cancelled before the influencer begins work are eligible for a full refund. Once work has begun, refunds are handled on a case-by-case basis.
If a dispute arises, either party may open a formal dispute through the Platform. Afrofluencer will review the case and determine an appropriate resolution, which may include a full refund, partial refund, or release of payment to the influencer.
9. Intellectual Property
Content created by influencers as part of a completed order is licensed to the brand for the purposes described in the package or campaign brief. Unless otherwise agreed, the influencer retains ownership of the original content.
Users may not copy, modify, or distribute any content from the Platform without permission. The Afrofluencer name, logo, and branding are the property of Powercave Int'l Ltd and may not be used without written consent.
10. Prohibited Conduct
Users may not use the Platform to:
- Engage in fraud, deception, or misrepresentation
- Harass, abuse, or threaten other users
- Circumvent Platform payments or communicate off-platform to avoid fees
- Post content that is illegal, harmful, or violates third-party rights
- Use bots, scrapers, or automated tools to access the Platform
- Attempt to gain unauthorised access to other accounts or systems
11. Termination
Afrofluencer reserves the right to suspend or terminate any account at its sole discretion, including for violation of these Terms. Users may also delete their account at any time through the dashboard settings. Pending orders and escrow balances will be handled according to our cancellation and refund policies.
12. Limitation of Liability
Afrofluencer provides the Platform on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Platform's availability, reliability, or suitability for any purpose. To the maximum extent permitted by law, Afrofluencer shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform.
13. Changes to Terms
We may update these Terms from time to time. We will notify users of material changes via email or an in-app notification. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or use of the Platform shall be resolved in the courts of Lagos, Nigeria.
